These Terms of Service ("Terms") govern your use of the Moterra mobile application ("the App", "Moterra", "we", "our", or "us"). By using Moterra, you agree to be bound by these Terms.
Please read these Terms carefully before using the App.
BETA PROJECT NOTICE
IMPORTANT: Please read carefully.
Moterra is currently a personal project in early beta testing. These Terms of Service serve as guidelines for beta participation, but you should be aware:
- No formal legal entity: Moterra is not a registered company or legal entity. It is operated by Aaron Mennitto as a personal project with assistance from friends.
- No legal review: These terms have not been reviewed or approved by legal counsel.
- No registered IP: No copyrights, trademarks, or other intellectual property rights have been formally registered for Moterra. All rights mentioned are informal claims.
- Limited enforceability: Without a formal legal entity, the enforceability of these terms may be limited. They serve as good-faith guidelines for respectful use of the app during beta testing.
- No warranties: As a personal project, we provide no formal warranties, guarantees, or legal assurances beyond our best efforts.
- Subject to change: As Moterra evolves from a personal project to a formal product, these terms will be updated and reviewed by legal professionals.
By participating in the beta, you acknowledge that this is an early-stage personal project and accept the informal nature of these terms.

1. Acceptance of Terms
By downloading, installing, or using Moterra, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the App.
1.1 Age Requirements
You must be at least 13 years old (or 16 in the European Union) to use Moterra. By using the App, you represent that you meet this age requirement.
1.2 Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms.
2. Beta Testing Disclaimer
IMPORTANT: Moterra is currently in BETA testing.
2.1 Beta Software Risks
By using Moterra during the beta period, you acknowledge and accept:
- Bugs and errors: The App may contain software bugs, errors, or defects
- Data loss: Your data (rides, bikes, settings) may be lost or corrupted
- Service interruptions: The App or sync service may be unavailable at times
- Incomplete features: Some features may be partially implemented or missing
- Frequent updates: The App may change significantly during beta
- No warranty: The App is provided "AS IS" without warranties of any kind
2.2 Beta Tester Responsibilities
As a beta tester, you agree to:
- Provide honest feedback about bugs, issues, and user experience
- Not rely on the App for critical or safety-related purposes
- Regularly back up any important ride data
- Report security vulnerabilities responsibly
- Not share beta builds with non-testers (if applicable)
2.3 Beta Data Retention
We reserve the right to delete or reset beta test data at any time during the beta period. While we will make reasonable efforts to preserve your data, we cannot guarantee data retention during beta testing.
3. License Grant
3.1 Limited License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Moterra for personal, non-commercial purposes.
3.2 Restrictions
You may NOT:
- Modify, reverse-engineer, or decompile the App
- Remove copyright or proprietary notices
- Use the App for any illegal or unauthorized purpose
- Sell, rent, lease, or sublicense the App
- Use the App to harass, harm, or violate the rights of others
- Attempt to gain unauthorized access to our servers or systems
- Use automated tools to scrape or download data from the App
4. User Responsibilities
4.1 Account Security
- You are responsible for maintaining the security of your account credentials
- You must use a strong password and keep it confidential
- You are responsible for all activity that occurs under your account
- Notify us immediately if you suspect unauthorized access to your account
4.2 Accurate Information
- You agree to provide accurate information when creating an account
- You are responsible for keeping your email address up to date
4.3 Lawful Use
- You agree to use Moterra only for lawful purposes
- You will not use the App to violate any local, state, national, or international law
4.4 Riding Safety
CRITICAL SAFETY DISCLAIMER:
- Moterra is a ride tracking tool, NOT a navigation or safety device
- Do NOT operate your device while riding a motorcycle
- Always prioritize safe riding practices over app usage
- Do NOT rely on the App for speed, distance, or route accuracy
- The App is not a substitute for proper motorcycle safety gear, training, or judgment
5. Prohibited Uses
You may NOT use Moterra to:
- Engage in illegal street racing or reckless riding
- Violate traffic laws or speed limits
- Harass, stalk, or endanger others
- Infringe on intellectual property rights
- Transmit malware, viruses, or harmful code
- Interfere with the App's operation or other users' access
- Collect or harvest user data without consent
- Use the App for commercial purposes without permission
6. Liability Limitations
6.1 GPS and Data Accuracy
IMPORTANT: Moterra uses GPS and user-provided data, which may be inaccurate, incomplete, or delayed.
We do NOT guarantee:
- Accuracy of GPS coordinates, speed, distance, or route data
- Availability of map tiles or network connectivity
- Accuracy of ride statistics or calculations
- Data integrity or backup reliability
6.2 No Liability for Damages
To the maximum extent permitted by law, Moterra and its developers, contributors, and service providers SHALL NOT be liable for:
- Data loss or corruption
- Personal injury or property damage related to app use
- Inaccurate GPS or ride data leading to poor decisions
- Service interruptions or unavailability
- Loss of profits, revenue, or business opportunities
- Indirect, incidental, consequential, or punitive damages
6.3 Maximum Liability
In jurisdictions where liability cannot be excluded, our total liability to you for all claims shall not exceed the amount you paid for the App (currently $0 for beta users).
6.4 Assumption of Risk
By using Moterra, you acknowledge that:
- Motorcycle riding is inherently dangerous
- You assume all risks associated with riding and using the App
- You are solely responsible for your safety and decisions while riding
7. Third-Party Services and Data Storage
Moterra integrates with third-party services and uses private infrastructure:

Your use of these services is subject to their respective terms of service and privacy policies:

We are not responsible for the availability, accuracy, or policies of third-party services.
7.2 Private API Server
- Your ride data, bikes, and settings are stored on our private API server (not Supabase)
- The server is currently hosted privately during beta (not enterprise cloud infrastructure)
- Server availability, uptime, and performance are not guaranteed during beta
- We reserve the right to migrate to different infrastructure in the future
8. User Content
8.1 Your Data
You retain ownership of all data you create in Moterra (rides, bikes, settings). By using cloud sync, you grant us a limited license to store, process, and transmit your data to provide the sync service.
8.2 Feedback
If you provide feedback, suggestions, or ideas about Moterra, you grant us a perpetual, royalty-free license to use, implement, or incorporate that feedback without compensation or attribution.
9. Termination
9.1 Termination by You
You may stop using Moterra at any time by:
- Uninstalling the App
- Deleting your account (Profile > Delete Account)
9.2 Termination by Us
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- You abuse or misuse the App or our services
- We discontinue the App or service
9.3 Effect of Termination
Upon termination:
- Your license to use the App ends immediately
- Your account and data may be deleted (subject to our Privacy Policy)
- You must stop using the App and delete it from your devices
10. Intellectual Property
10.1 Ownership
Moterra, its code, design, logo, and content are owned by Aaron Mennitto or licensed to us. All rights not expressly granted to you are reserved.
10.2 Trademarks
"Moterra" and related logos are trademarks. You may not use these trademarks without written permission.
10.3 Open Source
Portions of Moterra may use open-source software licensed under various open-source licenses (e.g., Flutter framework). These components are subject to their respective licenses.
11. Privacy
Your use of Moterra is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect and use your data.
12. Disclaimers
12.1 "AS IS" Basis
MOTERRA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness
- Uninterrupted or error-free operation
12.2 No Professional Advice
Moterra does not provide professional advice (mechanical, legal, medical, or otherwise). Any information in the App is for general informational purposes only.
13. Indemnification
You agree to indemnify, defend, and hold harmless Moterra, its developers, contributors, and service providers from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any law or third-party rights
- Your riding activities or decisions based on App data
14. Governing Law
These Terms are governed by the laws of England and Wales without regard to conflict of law principles.
14.1 Dispute Resolution
Any disputes arising from these Terms or your use of Moterra shall be resolved through:

16. Beta-Specific Terms
16.1 Beta Period
The beta testing period will continue until we announce a public release. We may end the beta at any time with or without notice.
16.2 Beta Exclusivity
During the closed beta, access to the App is by invitation only. You may not share your account or invite others without our permission.
16.3 Feedback Expectations
While not mandatory, we encourage you to provide feedback via the in-app feedback feature or by emailing beta@moterra.app.
16.4 Transition to Public Release
When Moterra transitions from beta to public release:
- These Terms will be updated
- You will be notified of changes
- You may need to accept updated Terms to continue using the App
- We will make reasonable efforts to preserve your data during the transition

What you can do: Use Moterra to track your motorcycle rides for personal use
What you can't do: Reverse-engineer the app, use it illegally, or rely on it for safety-critical decisions
Our responsibility: We provide the app "as is" and are not liable for data loss, injuries, or damages
